Lawsuit Dismissed Against Eclipse Medical Inc., Employees and Others
VANCOUVER, British Columbia-November 19, 2009 Eclipse Medical Inc. is pleased to announce that the lawsuit by AMS Homecare Inc. filed in December 2007 against it, its employees and others was dismissed by the Supreme Court of British Columbia on October 26, 2009. The Court accepted that despite the demands of the Defendants to proceed, AMS Homecare Inc. had done nothing to advance the claims made against any of the Defendants and the case therefore deserved to be dismissed for want of prosecution. Each of the Defendants has been awarded their costs.
Mr. Jason Weinstein, General Manager of Eclipse Medical Inc. said that while the company and the employees are relieved to finally have had the claims dismissed, they are disappointed that they never had the chance to be exonerated by the Court as there was never any merit to the allegations being made. Eclipse Medical Inc. was sued by AMS Homecare Inc. after Eclipse Medical Inc. had successfully purchased the assets of a bankrupt subsidiary of AMS Homecare Inc. from the Trustee in Bankruptcy.
